AGREEMENT BETWEEN THE CITY OF LITTLE CANADA AND THE OWNERS OF REAL PROPERTY WITHIN THE CITY OF MAPLEWOOD TO PERMIT THE CONNECTION OF SAID REAL PROPERTY TO THE LITTLE CANADA MUNICIPAL WATER SYSTEM THIS AGREEMENT, made and entered into this day of , 2002, by and between the City of Little Canada, a municipal corporation, County of Ramsey, State of Minnesota, hereinafter referred to as "City ", and Schroeder Milk Co., Inc., a Minnesota corporation, hereinafter referred to as "Owner ". WITNESSETH: WHEREAS, the City has constructed and operates a municipal water system and has agreed with the undersigned Owner that the following described real property within the City of Maplewood be allowed to connect to the Little Canada municipal water system, pursuant to Minn. Stat. 444.075 and the conditions specified herein, and WHEREAS, it is beneficial that Owner be allowed to connect a portion of the following described real property to the said municipal water system for fire protection services. NOW, THEREFORE, it is mutually agreed that the real property to be connected to the system is described as follows: Parcel One, PIN #18- 29 -22 -22 -0015 (legal description to be determined), and Parcel Two, PIN #18- 29 -22 -23 -0015 (legal description to be determined). It is agreed by the parties hereto that the connection of the buildings that presently exist on the above described property is approved by this Agreement. The connection of any other structure on this property, which is constructed after the date of this Agreement, shall require the payment of an additional connection charge, as computed in the Voto, Tautges Report, dated November, 23, 1990, attached hereto as Exhibit "A" and incorporated herein by reference. The connection of any other real property because of additional development, including, but not limited to, parking, storage, or building structures, shall require subsequent approval of the City and shall require payment of an additional connection charge, as computed in Exhibit "A" or in a manner deemed or appropriate by the City. The present connection of the above described property is subject to the following conditions: 1. The Owner shall pay to the City the following charges: (a) A connection charge of Seventy -Nine Thousand Six I-Iundred Eighty -Three and 50 /100 ($79,683.50) Dollars, as determined by the City, pursuant to Minn.
