444.075 and applicable Little Canada Ordinances, shall be payable prior to the <br />time of connection or within five (5) days of demand by the City. <br />(b) Meter charges as determined by the City, shall be paid prior to the time of <br />connection or within five (5) days of demand by the City; and <br />(c) Quarterly water usage and availability charges shalt be payable by the Owner <br />within fifteen (15) days after mailing of the City's billing. The parties hereto <br />understand that said charges may be increased or decreased by amendment of the <br />applicable City Ordinances and /or Resolutions consistent with State Commercial <br />billing procedures. <br />2. If the Owner fails to pay the amounts as provided herein, the City will notify the City <br />of Maplewood of the amount of unpaid charges for certification of the same for <br />collection with the real estate taxes, pursuant to the Joint Powers Agreement between <br />the City and the City of Maplewood, which is attached hereto as Exhibit `B ". <br />3. In addition to the amounts described above, the Owner shall pay each quarter a "lost <br />water" charge to the City based on 20,000 gallons of water usage chargeable based on <br />the rates in effect for each respective quarter. Said charge does not entitle the Owner <br />to have access to nonmetered water service without prior approval of the City. <br />Owner agrees not to utilize the fire hydrants located on its property for any purpose <br />without prior approval of the City including necessary permits. <br />4. The City and Owner understand that the Owner has constructed a twelve (12 ") inch <br />water main, which proceeds from its existing property to its intersection with a twelve <br />(12 ") inch water main, owned by Cub Foods, as indicated on the attached Exhibit <br />"C ". It is further understood all costs incurred in making the connection are the <br />responsibility of the Owner. Owner agrees that the City owns the gate valve(s) <br />located on the water main, and the City has the right to maintain the water service <br />from the gate valve(s) to the water meter in the building. The Owner agrees that the <br />Owner is responsible for the maintenance of the water service. Owner agrees that the <br />City will supervise the installation of the water meters and the City will retain <br />ownership of the water meters, whether the water meters are located in buildings or <br />other areas. Owner agrees that no connection of any other real property other than <br />that described above will be made to said water main without the approval of the <br />City. <br />5. It is understood that this connection is being utilized for a fire suppression system <br />serving buildings "B" and "C" as indicated in Exhibit "C ". Fire suppression for <br />Building "A" is provided by the City of Roseville. Owner is also installing a private <br />well for domestic water usage. No cross connections are permitted between the City <br />of Little Canada's water system and either the City of Roseville's water supply <br />system or Owner's well water system. All potential cross connection piping will be <br />cut and capped and field inspected to verify that no connection exists. <br />6. Owner agrees to grant City access to the above described property for the purposes of <br />reading and inspecting the water meters and for making such other inspections as are <br />Page 2 of 4 <br />
