BOARD OF WATER COMMISSIONERS RESOLUTION — GENERAL FORM No 4809 COMMISS ONER Haselmann January 8, 2002 DATF WHEREAS, the Board of Water Commissioners does possess fee simple title to a one - hundred (100) foot wide strip of land and a seventy (70) foot wide easement right -of -way east of and adjacent to the fee simple property, both located in the SW quarter of the SW quarter of Section 31, Township 30 North, Range 22 West, Ramsey County, Minnesota, south of Country Drive and west of Spruce Street in the City of Little Canada, collectively the "Premises ", said Premises containing the Board's 90 -inch Vadnais Conduits; and WHEREAS, the City of Little Canada having entered into an Agreement with the Board o f Water Commissioners dated July 13, 1966, for the purposes of locating certain public works within the Board's rights -of -way in Ramsey County; and WFIEREAS, the City of Little Canada desires to construct and maintain a 12 -inch drainage culvert within the Premises; and WFIEREAS, staff has prepared a Twenty-Third Rider to that Agreement of July 13, 1966, which sets forth the conditions of construction and access over the Premises and which protects the Board's rights, interests, and facilities; and WHEREAS, the office of the city attorney has reviewed and approved said Twenty -Third Rider as to form, and staff recommends that the Board approve said Twenty -Third Rider; now, therefore, be it RESOLVED, that the Board of Water Commissioners does hereby approve the Twenty -Third Rider to Agreement with the City of Little Canada and that the proper officers of the Board are hereby authorized and directed to execute said Twenty -Third Rider on behalf of the Board.
