Several property corners were
located along Noel Drive to verify the existing right -of -way width and the location of the current city
improvements within the right -of -way. As shown on the half section map, there is currently a 60 -foot
right -of -way along Noel Drive. This is 10 feet wider than the typical 50 -foot right -of -way that is
required by City Ordinance for a City street. It was also verified that the street is generally centered
within the right -of -way. Therefore, the vacation would not negatively impact any of the existing public
improvements. When the street is reconstructed, it is anticipated that all public improvements could
be completed within 50 feet of right -of -way as done on other streets within the City.
If the City Council approves the street right -of -way vacation, we would recommend that 5 feet be
vacated from each side maintaining the existing centerline of the right -of -way. We would also
recommend that the vacated 5 feet be maintained as a drainage and utility easement.
If you have any questions regarding these comments, please feel free to call.
Sincerely,
Howard R.
