Fahey <br />COUNCIL <br />Jim LaValle <br />Matt Anderson <br />Rick Montour <br />Bill Blesener <br />ADMINISTRATOR <br />Joel It Hanson <br />St. Jude Medical, Inc. is proposing to install a fiber cable between the Lillehei site located on the north side <br />of Highway 36 to the Woodridge site located on the south side of highway 36 so their data centers can <br />communicate more efficiently. To accomplish this they have requested permission to bury a portion of the <br />fiber cable within city right -of -way along Viking Drive as shown on the attached map. <br />The attached right -of -way agreement will allow St. Jude Medical, Inc. to place a fiber cable within city <br />right -of -way. This agreement defines right -of -way use as well as maintenance and reconstruction <br />responsibilities in the future. <br />Staff recommends City Council adoption of this agreement subject to: <br />• City Attorney review and approval. <br />• Application and approval of a City Right -of -way permit. <br />• Contractor doing this work obtaining a City excavators license. <br />H: \GregS \Correspondence \Greg S 2003\St. Jude right -of -way agreement.doe <br />
