3. One accessory shed (not exceeding 120 square feet). <br />In addition to the preceding requirements, Section 903.020.D.5 of the ordinance states <br />that in no instance shall the total floor area of a garage and an accessory building(s) <br />exceed 1,500 square feet in size except by conditional use permit. <br />As previously indicated, it appears that detached accessory buildings measuring 384 <br />square feet (west building) and 320 square feet (east building) presently exist upon the <br />subject property: Including the proposed 936 square foot detached building /garage, a <br />total of 1,640 square feet of detached accessory storage space would therefore exist on <br />the property. <br />To be noted is that the above referenced existing building area calculations are not <br />consistent with those provided by the applicant. The applicant has indicated that the <br />total detached accessory building area on the site, including the proposed 936 square <br />foot building, would total 1,465 square feet. Regardless of the accuracy of the building <br />area calculation, the total accessory building areas are not to exceed to allowances <br />mentioned above. <br />Setbacks. According to the ordinance, accessory buildings may be no closer than 10 <br />feet from a side or rear lot line or within 30 feet of a public right -of -way. <br />As shown on the submitted site plan, both the existing home on the property and <br />westernmost shed fail to meet setback requirements and exist as legal nonconformities. <br />The home exhibits a 12 foot setback from the Boss Road right -of -way while the <br />westernmost shed encroaches upon the right -of -way. With a setback of 22 feet from <br />right -of -way, the proposed accessory building fails to meet the minimum 30 foot setback <br />requirement. <br />While it is recognized that Boss Road is not improved and that legal nonconforming <br />setbacks presently exist along the right -of -way, the proposed accessory building should <br />be shifted eastward to meet the applicable 30 foot setback requirement. In the <br />alternative, the City may consider a vacation of a portion of the right of way, if <br />appropriate. The right of way shown on the survey is 60 feet in width, whereas the <br />City's standard for residential area streets is 50 feet. <br />Access. The submitted site plan does not illustrate a driveway to the proposed <br />accessory building. Recognizing that Boss Road is presently unimproved, it is <br />recommended that access to the accessory structure be provided via the site's existing <br />driveway access (from Bryan Street) and that no new curb cuts be allowed on the site. <br />Building Materials. No information has been provided in regard to building finish <br />materials. As a condition of CUP approval, it is recommended that the same or similar <br />quality exterior building material be used on the accessory building as the principal <br />3 <br />
