No information has been provided regarding the height of the <br />proposed accessory structure. As a condition of CUP approval, the proposed <br />accessory building should not exceed the maximum 15 foot height requirement of the <br />Ordinance. <br />Building Use. As previously indicated, it is the applicant's intent to utilize a portion or <br />all of the proposed accessory structure as a "warming house" in the winter months (for <br />rear yard skating activities). It is understood that such activity is not a "business" <br />activity. As a condition of CUP approval, no commercial of home occupation activities <br />may be conducted on the property. <br />Lighting. While somewhat unrelated to the accessory building proposal, it is believed <br />an assurance should be made that the proposed rear yard skating activities do not <br />negatively impact the area. In this regard, it is recommended that any lighting used to <br />illuminate the skating area be hooded and directed such that the source of the light is <br />not visible from neighboring properties. <br />RECOMMENDATION <br />Based on the preceding review, our office recommends approval of the conditional use <br />permit subject to the following conditions: <br />1. The proposed accessory building be shifted eastward to meet the applicable 30 <br />foot setback requirement from Boss Road. <br />2. Access to the accessory structure be provided via the site's existing driveway <br />(from Bryan Street). <br />3. The same or similar quality exterior building material be used on the accessory <br />building as the principal building. <br />4.
