building. Additionally, the color of the accessory building (siding and roofing) should
likewise match that of the principal building.
Building Height. No information has been provided regarding the height of the
proposed accessory structure. As a condition of CUP approval, the proposed
accessory building should not exceed the maximum 15 foot height requirement of the
Ordinance.
Building Use. As previously indicated, it is the applicant's intent to utilize a portion or
all of the proposed accessory structure as a "warming house" in the winter months (for
rear yard skating activities). It is understood that such activity is not a "business"
activity. As a condition of CUP approval, no commercial of home occupation activities
may be conducted on the property.
Lighting. While somewhat unrelated to the accessory building proposal, it is believed
an assurance should be made that the proposed rear yard skating activities do not
negatively impact the area. In this regard, it is recommended that any lighting used to
illuminate the skating area be hooded and directed such that the source of the light is
not visible from neighboring properties.
RECOMMENDATION
Based on the preceding review, our office recommends approval of the conditional use
permit subject to the following conditions:
1. The proposed accessory building be shifted eastward to meet the applicable 30
foot setback requirement from Boss Road.
2. Access to the accessory structure be provided via the site's existing driveway
(from Bryan Street).
3. The same or similar quality exterior building material be used on the accessory
building as the principal building.
4. The color of the accessory building (siding and roofing) match the color of the
principal building.
5. The proposed accessory building not exceed the maximum 15 foot height
requirement of the Ordinance.
6. No commercial of home occupation activities be conducted on the property.
7. Any lighting used to illuminate the site's skating area be hooded and directed
such that the source of the light is not visible from neighboring properties.
