Hanson
September 25, 2003
Mr. Jim Cossack
421 Eli Road
Little Canada, MN 55117
Re: Accessory Building Violations
Dear Mr. Cossack:
The City Council denied your variance request to allow the existence of the accessory
building you constructed in your rear yard area without a permit. The Planning
Commission noted that you have three options to resolve this issue. Those options are:
1. Connect the building to the house to make it part of the principal
structure. Please note that this option may have a number of issues
involving compliance with the building code and you will need to work
through the exact details with Steve Westerhaus, our Building Official.
We will also need to decide upon what type of inspections will be
necessary to verify compliance with the building code for the portion
illegally constructed.
2. Reduce the size of the building to less than 160 square feet. Again, plan
details will need to be resolved with the Building Official as will
inspection of the existing construction that is to remain.
3. Tear down the building. (A demolition permit will be required for this
action.)
The City will not allow the current violation to continue. Therefore, we need to know
which of these options you will pursue by no later than 4:30 p.m. on Thursday, October
2, 2003. Based upon the option you chose, we will then work out a correction plan with a
"date certain" for completion of the agreed upon work. It is to be understood that we will
be working with the expectation that this matter is to be fully resolved before the end of
this year. Should we not hear from you by October 2 "d, the City Council will then
consider this matter at their meeting of October 8, 2003. The likely course of action will
be to commence a court action against you to achieve removal of the structure.
