Bathrooms, <br />toilet rooms, closets, halls, storage or utility spaces and similar areas are not considered habitable <br />spaces." <br />Fence: <br />History: <br />On August 19, 2003 a citation was issued to Mr. Cossack for constructing a fence without a <br />permit. August 26, 2003 Mr. Cossack applied for a permit to construct a fence in his rear yard. <br />After receiving a survey, which indicated the fence location, his permit was approved on <br />September 4, 2003. After leaving 1 message and talking to Mr. Cossack personally 2 more times <br />he came to City Hall on September 17, 2003 and paid for his permit for a fence to be <br />constructed. Mr. Cossack was given a copy of the ordinance as it relates to fences on residential <br />property at the time he paid for his fence permit. <br />Analysis: <br />Little Canada Ordinance requires that fences on interior lots be located in the rear yard no closer <br />than the front building line of the principle building and the fence must not exceed 6 1/2 feet in <br />height. Fences must be entirely on the owner's property unless written permission is given from <br />the property owners involved. <br />If the fence exists as an enclosure then an ingress point must be provided for emergency vehicles <br />and must be a minimum of 10 feet in width and must be located on the front line of the fence <br />between the principle structure and the side lot line. <br />Summary: <br />The entire portion of the fence, including the posts must not exceed 61 feet. I believe that if <br />additional features such as lights or ornamental lattice are permanently added to the fence, the <br />fence along with the additional extras must not exceed 6 1/2 feet in height. If light poles separate <br />and independent from the fence are to be added then the poles would have to meet all setbacks <br />that pertain to R -1 Zoning District, (10 foot side yard and 30 foot front and rear yard setbacks). <br />Lights would also have to conform to ordinances that relate to glare. <br />3 <br />
