for any accrued and unused vacation. No compensation shall be given for any unused sick <br />leave except as outline in Section 18 of the City's Personnel Policy dealing with Severance <br />Pay. However, in the event Provos is terminated because of her conviction for any illegal act <br />involving personal gain to her, then City shall have no obligation to pay the aggregate salary, <br />accrued and unused vacation or sick leave provided in this paragraph. <br />If prior to July 22, 2014, City reduces the salary or other financial benefits to Provos <br />in a greater percentage than across - the -board reduction for all City employees, or if City <br />refuses, following written notice, to comply with any other provisions of this Agreement <br />benefiting Provos, then Provos may, at her option, be deemed to be "terminated" on the date <br />of such reduction or refusal to comply with the provisions of this Agreement. In this event, <br />Provos shall be entitled to severance pay in accordance with this Agreement. <br />If Provos voluntarily resigns her position with the City, Provos agrees to give City twenty - <br />eight (28) days advance notice. If Provos voluntarily resigns her position with City, there <br />shall be no severance pay due to Provos nor payment for unused sick leave, except as provided <br />for in Section 18 of the City's Personnel Policy dealing with Severance pay. Provos will be <br />paid for unused vacation pay. <br />16. OTHER PROVISIONS TO APPLY. Provos shall be subject to Section 15 of City's <br />Personnel Policy entitled "Computer Use Policy" and Section 16 "Other Information" during <br />her tenure with City. Provos acknowledges receipt of this section as well as any other sections <br />of the Personnel Policy previously referenced in this Agreement. <br />17. SEVERABILITY. If any provision, or any portion thereof, contained in this Agreement is <br />held to be unconstitutional, invalid, or unenforceable, the remainder of this Agreement, or <br />5 <br />
