3.04 Notice of Construction Commencement. Not less than forty -eight (48) hours <br />prior to commencement of the Little Canada Transit Center Project by the Contractor, the City <br />will give written notice to the Council of its intention to commence construction. <br />3.05 Construction Changes. The Council will review and approve any amendments <br />to or changes in the approved plans, specifications, or final construction documents, including <br />the construction schedule, which affect the Little Canada Transit Center Project. The City must <br />submit the relevant amendments or changes to the Council at least two (2) business days before <br />the implementation of such amendment or change. The agrees that it will not proceed with any <br />amendment or change in the approved plans, specifications, or final construction documents <br />which affects the Little Canada Transit Center Project until the Council has approved such <br />amendment or change. The Council's approval will not be unreasonably withheld. <br />3.06 Non - Employee Status. The City agrees that any and all of its employees and all <br />other persons and Contractors employed by the City in the performance of any work or services <br />required or provided under this agreement, shall not be considered employees of the Council. <br />3.07 Ownership. Notwithstanding the payment of funds by the Council, upon <br />completion of the project, the City shall take ownership and responsibility for maintenance of all <br />street lighting and planters as part of the Project. In addition, the City retains control of all street <br />right of way improved as part of this project. Council will retain ownership of the passenger <br />waiting shelters, and all appurtenances related to the shelters, installed by the Council as part of <br />this Project. <br />IV. PAYMENT OF PROJECT COSTS <br />4.01 Council Funding Contribution. Council will pay costs associated with <br />constnrction of this facility, as designated in Exhibit "A ". The contractor shall be paid by the <br />City through the project. The City shall then be reimbursed for costs, as designated in Exhibit <br />"A ", by payment from Council. <br />-5- <br />
