This agreement provides for the Council to assist in payment for the construction and contract <br />administration of the project by the City's issuance of a contract for 2003 Street Improvements. <br />The City will pay the contractor awarded this project directly. This agreement also allocates the <br />rights and responsibilities of the parties in relation to the Little Canada Transit Center Project. <br />III. CONSTRUCTION OF THE TRANSIT CENTER <br />3.01 Design. The City will prepare design plans and specifications for construction of <br />the Little Canada Transit Center Project. The design must meet all applicable federal, state, and <br />local requirements for transit facilities, including the ADA. Unless specified otherwise, all <br />specifications will follow those of the project. Approval of these plans and specifications by the <br />Council shall in no event be deemed to warrant the adequacy of the design or the quality of the <br />materials used in the construction of any portion of the Project. <br />3.02 Contract Documents. The City will prepare the documents in compliance with <br />all applicable federal, state, and local requirements. The Contractor will submit a schedule for <br />the staging of the work to the Council for review and approval, which approval shall not be <br />unreasonably withheld. Upon Council approval, the City shall authorize the contractor to <br />complete the Council's portion of the work and constrict the Project. <br />3.03 Construction. The City will administer the Contractors' contracts, inspect the <br />work for their own satisfaction, and complete the construction of the Little Canada Transit <br />Center Project in accordance with the approved plans, bid specifications, contracts, construction <br />schedule, and all applicable laws. The City is responsible for making all direct payments to the <br />Contractor for work performed on the Project. If the Project work is not in conformance with the <br />approved plans and specifications, the Council will also inform the City of the specific reasons <br />for non - conformance with the approved plans and specifications, and what steps, in the Council's <br />opinion, must be taken by the City to make the Project work conform. Upon completion of the <br />Project in conformance with the approved plans, the Council's Project Manager will inform the <br />City in writing of the Council's acceptance of the Project work. The Council will not <br />unreasonably withhold acceptance of the Project work. <br />-4- <br />
