I- Ianson <br />Attached is the proposed development agreement for the Hamel Estates plat. This follows our <br />standard form for these types of agreements with the following notable differences: <br />• Removal of existing access to Twin Lake Blvd. <br />•3 Waiver of Right to Appeal Special Assessments relating to the Twin Lake area street and <br />water main improvements that will be forthcoming. <br />The amount of the waiver is based on what the property would have been assessed before the <br />Hamel Estates development occurred and has been increased by 3% per year to provide for a <br />maximum allowance of up to three years before the project is assessed. <br />Potential to eliminate the on -site storm water pond within Hamel Estates and connect to a new <br />storm sewer system for the Twin Lake area that will discharge to I -694. This is subject to MN <br />DOT approval and to timing considerations to meet the developer's objectives. If we are <br />successful in pursuing this option, the developer will contribute an amount equal to the costs <br />they save by not constructing the pond including appropriate overhead. <br />Subject to final comments by the City Attorney, staff would recommend approval as presented. <br />cc: Rob Carlson <br />
