Hamel Estates <br />Development Contract <br />25. Developer shall eliminate existing access to Owasso Boulevard located in the <br />vicinity of Lot 1, Block 2. All access to the lots contained within Hamel Estates shall be via <br />Hamel Court. <br />Easements <br />26. Developer shall acquire and dedicate easements as necessary for the construction <br />and maintenance of the Required Improvements pursuant to City requirements, including, but not <br />limited to utility easements for sanitary sewer and water systems and any other easements the <br />City deems appropriate. Developer shall pay all costs relating to the acquisition of the necessary <br />easements, including attorney's fees, costs, appraisals, the cost of the necessary property, and <br />any other special conditions which Developer shall negotiate with any affected property <br />owner(s). Developer also agrees to reimburse City for any costs associated with the acquisition <br />of the easements including drafting, review and recording. <br />27. Developer shall obtain consents to any required easements as necessary. <br />28. Developer hereby grants City, its agents and employees, a license to enter any of <br />Developer's property to perform all necessary work, maintenance and /or inspections deemed <br />appropriate by the City during the construction of the Required Improvements. The license shall <br />expire after the Required Improvements are installed and approved by the City. <br />Miscellaneous <br />29. The Developer represents that the Plat complies with all city, county, <br />metropolitan, state, and federal laws and regulations, including but not limited to: subdivision <br />ordinances, zoning ordinances, and environmental regulations and permits thereto related. If the <br />City determines that the Plat does not comply, the City may refuse to allow construction or <br />development work in the Plat until compliance is achieved. Developer represents to City that the <br />Required Improvements will comply with all City, County, Metropolitan, State and Federal laws <br />- 7 - <br />
