Such permit was subject to the fulfillment of a number of <br />conditions including a stipulation that the existing 85 foot wide curb cut on Spruce Street <br />be narrowed via the construction of a centralized median. <br />Due to expectant drainage problems associated with the construction of such median, <br />the applicant has requested that such condition of the original CUP approval be omitted. <br />To be noted is that the applicant has fulfilled all the conditions of the original CUP with <br />the exception of the condition related to the Spruce Street curb cut width. <br />ANALYSIS <br />The existing 85 wide curb cut width on Spruce Street exists as a legal non - conforming <br />condition. According to the zoning ordinance, curb cut widths within industrial zoning <br />districts may not exceed 32 feet except as otherwise approved by the City Engineer. <br />As part of the original CUP consideration, staff recognized such non - conformity and <br />attempted to lessen its extent by requiring the installation of a centralized median.
