median which would essentially result in the creation of two smaller curb cuts along <br />Spruce Street. <br />The applicant has indicated that, in times of heavy rainfalls, stormwater tends to pool at <br />along Spruce Street at the entrance to his property and construction of a curb cut <br />median (as required as part of the original CUP) would escalate the existing drainage <br />problem. <br />The applicant has indicated a willingness to narrow the curb cut width to the extent <br />possible but believes the centralized median concept would negatively affect the <br />functioning of his site. <br />In review of the photographs submitted by the applicant (see Exhibit C), it is evident that <br />a drainage problem exists in the area. It is believed that the elevation of the street and <br />a lack of stormsewer in the area eliminates the usual solution to this problem. <br />While the elimination of the curb cut median appears justified, the City Engineer should <br />provide comment and recommendation on the matter. <br />RECOMMENDATION <br />Based on the preceding review, it is evident that a drainage problem exists in the area <br />and that the construction of a centralized median within the Spruce Street curb cut could <br />further such problem. With this in mind, our office recommends approval of the <br />conditional use permit amendment subject to the following conditions <br />1. The remaining conditions of the original conditional use permit remain applicable. <br />2. The City Engineer finds the proposed elimination of the curb cut median to be <br />acceptable. <br />3. The curb cut be narrowed to the extent possible as determined appropriate by <br />the City Engineer. <br />4. Comments of other City staff. <br />pc.
