MINUTES <br />PLANNING COMMISSION <br />SEPTEMBER 11, 2003 <br />AMENDMENT <br />TO CUP — <br />182 RYAN <br />DRIVE — <br />DAVE EVANS <br />Mr. Cossack has recently applied for a fence permit, however, has not yet <br />paid for that permit. The Building Official has indicated on the building <br />permit application form that the fence is six feet high. <br />Other members of the audience expressed concern with Mr. Cossack's <br />lack of regard for the City's ordinances and the lack of City action in not <br />stopping construction of the accessory building. <br />The City Planner reported that the City has sent violation notices to Mr. <br />Cossack and has cited him. He has ignored these actions, and eventually <br />the matter will likely end up in court. The Planner indicated that Mr. <br />Cossack has put himself at risk by continuing to spend money on an <br />accessory building that is in violation of the code. The Planner noted that <br />City correspondence to Mr. Cossack on this issue dates back to 2002. <br />One member of the audience asked why Mr. Cossack has the option of <br />connecting the recreation building to his house. She felt the building <br />should either be removed or reduced in size. <br />The Planner indicated that Mr. Cossack has the options outlined earlier. If <br />he chooses to attach the accessory building or reduce it in size, he will <br />have to obtain all the necessary building permits, and may be required to <br />open up portions of the structure so that inspections can occur. The <br />Planner noted that the action for the Planning Commission this evening is <br />to act on the variance requests. <br />Knudsen recommended denial of the Variances to size and dimension for <br />a recreational accessory building as requested by Mr. Jim Cossack at 421 <br />Eli Road given there is no hardship present to warrant granting the <br />variances. <br />Motion seconded by Roycraft. <br />Motion carried 7 — 0. <br />The Commission reviewed the request by Dave Evans for an Amendment <br />to a Conditional Use Permit to allow a change in the site plan for 182 <br />Ryan Drive increasing the driveway width. It was noted that Mr. Evans <br />was not present this evening. <br />The City Planner reviewed his report dated September 5, 2003 and noted <br />that his report relied on Mr. Evan's assertion that there were drainage <br />problems on his property. The City Engineer has since reviewed the site <br />and determined that installation of the island that was previously approved <br />-6- <br />
