Drywall Supply Addition <br />Development Contract <br />acquisition of any easements, shall be paid. Cost for City staff time expended in conjunction <br />with this Contract are expected to equal two and one half percent (3.5 %) of the construction cost <br />involved in the Contract. Said fee can be increased or reduced in the sole discretion of the City, <br />should staff time required vary dramatically from this estimate. This provision is consistent with <br />an agreement between the City and Developer, dated August 30, 2002, which is attached hereto <br />and incorporated herein as Exhibit C. <br />Engineering <br />16. The Developer shall grade the Plat as shown on the Grading, Drainage & Erosion Control <br />Plan prepared by the Developer's engineer and subject to the approval of the City's engineer. <br />Said Plan must also be approved by the Ramsey - Washington Watershed District, including the <br />completion of a municipal coordination check list. It is also understood that the Erosion control <br />plan must be such that drainage to adjacent property is prevented and service water run off is <br />properly controlled. Developer agrees to comply with any and all requirements for erosion <br />control directed by the Ramsey- Washington Watershed District and /or the City in a timely <br />matter. Developer's engineer shall certify that Plat grading is completed in accordance with the <br />approved grading and sediment control plan before the City shall issue any building permits. <br />The Developer shall remain ultimately responsible for accurate grading of all lots and shall <br />correct deficiencies in grading that may be discovered while this agreement is in effect. <br />17. Developer, District Council 82, or their agents or assigns, shall keep the public <br />streets clear of any soil, earth or debris resulting from work done by Developer, District Council <br />82, or their agents or assigns. Any such materials must be promptly removed and in no event <br />shall they be present more than 24 hours after placement. Failure to comply with this provision <br />will result in the City undertaking this work with costs to be reimbursed by Developer pursuant <br />to Paragraph #I5. <br />18. The Developer shall cause to be performed to the City Engineer's satisfaction all <br />finish grading, and shall maintain said grading, until Certificates of Occupancy are issued for all <br />_5_ <br />- 5 - <br />
