DEVELOPMENT AGREEMENT <br />THIS AGREEMENT is made and entered into as of the day of , by and <br />between the CITY OF LITTLE CANADA, MINNESOTA (the "City ") and N STAR ASSOCIATES <br />LIMITED PARTNERSHIP, a Minnesota limited partnership ( "North Star "). <br />RECITALS <br />A. WHEREAS, Minnesota Statutes 327.2, Subdivision 1, requires manufactured home parks <br />licensed prior to 1988 to have an evacuation plan or a storm shelter approved by the local <br />municipality, and <br />B. WHEREAS, North Star Estates ( "NSE ") is a manufactured home park with over 500 residents <br />located in the City of Little Canada, and <br />C. WHEREAS, a reasonably accessible storm shelter does not exist within North Star or in close <br />proximity, and <br />D. WHEREAS, the City has approved an interim evacuation plan that utilizes the basement of St. <br />John's Church as the designated storm shelter site pending the construction of a new storm <br />shelter within NSE, and <br />E. WHEREAS, the City has received Community Development Block Grant Funding from <br />Ramsey County for a new shelter (the "Storm Shelter ") to be constructed within NSE in the <br />location shown on attached Exhibit "A" (the "Storm Shelter Site "), and <br />F. WHEREAS, the City and North Star want to cooperate to the fullest extent possible to <br />construct the Storm Shelter within NSE as soon as practical in calendar year 2003, and <br />G. The purpose of this Agreement is to set forth the understanding between the City and North <br />Star with respect to the construction and operation of the Storm Shelter within NSE. <br />TERMS AND CONDITIONS <br />NOW, THEREFORE, in consideration of the mutual undertakings herein expressed, the City and <br />North Star agree as follows: <br />1. Full Cooperation. North Star and the City agree to cooperate fully with each other to achieve <br />the successful completion of the Storm Shelter construction project. North Star acknowledges <br />its responsibilities pursuant to the grant application filed with Ramsey County, which is <br />attached hereto as Exhibit B (the "Grant Application ") and further agrees to assist the City in <br />any reasonable way to ensure the City's compliance with Community Development Block <br />1 <br />-2 <br />Development Agreement v41.DOClN'7530.03 <br />(BLM)[08/22/03Qa41/0-3/3:00 PM3''19 PM] <br />
