policy shall be furnished to North Star prior to commencement of construction. City shall <br />cause North Star to be named on the insurance policy required furnished pursuant to said <br />Contract. <br />6. Access to Property. North Star shall furnish the City and contractor reasonable access to the <br />Storm Shelter Site across the existing streets and common areas of the community. <br />7. Subdivision of Properties. A subdivici n of pr perry by N rth Star may be necessary to <br />create a separate legal description and convey the <br />e " rth Star in <br />g�uhdivisi n. 'this Subdivision shall n t be deemed to violate any state, <br />local or count., subdiv isi n laws or rdinances. North Star Ns i11 submit such subdivision <br />rot later than September 22, 2003, if a subdivision is required. <br />8. Convcvanec Lease of Property. North Star agrees to convey lease to the City fee tide to -the <br />Storm Shelter Site which is approximately 1250 square feet in size, and shall provide <br />any reasonably needed access easements over and across existing roadways with NSE. The <br />City shall not, at any time, permit any liens or other charges to be placed against the Storm <br />Shelter Site or NSE. The City's interests lease in-of the Storm Shelter Site shall automatically <br />revert back toterminate if North Star if NSE no longer operates as a manufactured home park <br />for a period of one year. Said re tit claim deed and City agrees to <br />e-xec-ti1e said deed imme :quest f North Star or North Star's successors or <br />assigns. <br />9. Ownership of the Storm Shelter. North Star acknowledges that the City shall be the owner <br />of the Storm Shelter and related appurtenances. The City shall construct, or cause to be <br />constructed, the Storm Shelter and related improvements in compliance with local ordinances, <br />regulations and restrictions, including but not limited to those contained in the Program <br />Agreement. North Star shall not be responsible for any deficiency in the construction of the <br />Storm Shelter, City's failure to comply with applicable ordinance, restrictions and codes, <br />including the Program Agreement, or any costs or expense associated with the correction of <br />any such deficiency or fees or fines or any other costs associated therewith. North Star shall <br />have the right to approve the construction plans for said shelter, and approval may not be <br />unreasonably withheld. <br />10. Lease Agreement. At the time the - construction of the Storm <br />Shelter is completed, the City hereby agrees to enter into a lease agreement with North Star <br />(the "Lease ") in the form attached hereto as Exhibit "D" relating to the Storm Shelter and the <br />Stele , _ ikon the terms and conditions contained therein. North Star shall be <br />responsible for insuring the shelter and for on -going maintenance during the term of the lease. <br />11. North Star Contingencies.
