If North Star fails to perform pursuant to this Agreement or any amendment to <br />this Agreement, and such failure is not the result of a delay caused by the City or other <br />reasonable delay based upon weather, soil or other conditions whether under the control of <br />North Star or not, then North Star shall be deemed in breach of this Agreement and the City <br />may terminate this Agreement upon ten (10) days written notice provided North Star does not <br />cure such delay or failure within such ten (10) days. The City may then seek to enforce <br />Minnesota Statutes 3272.20, subdivision 1 without any financial assistance to North Star. <br />Upon completion of the construction of the Storm Shelter in accordance with the terms and <br />conditions of this Agreement, North Star shall be in compliance with all applicable laws <br />regarding construction of a storm shelter and /or provision of an evacuation plan for residents of <br />NSE. <br />13. Counterparts.
