7. Inspections and Staking. Developers shall instruct their engineer to provide adequate field <br />inspection personnel to ensure the project is constructed in accordance with approved plans and specifications. In <br />addition, the City's Engineer, at Developers' expense, shall also inspect the construction of public improvements for <br />the purpose of certifying the same and recommending acceptance by City. Developers shall also complete <br />construction staking for the project at Developers' expense. <br />8. Easements. Developers shall acquire and dedicate any easements as deemed necessary for the <br />construction and maintenance of the public and private improvements pursuant to City requirements including any <br />easements necessary for the sanitary sewer and water systems. Developers shall pay all costs relating to the <br />acquisition of the necessary easements, including attorneys' fees, costs, appraisals, the cost of the necessary property, <br />and any other special conditions that Developers shall negotiate with any affected property owner(s). Developers <br />also agree to reimburse City for any costs associated with the acquisition of the easements including drafting, review <br />and recording. <br />9. Consents to Easements. Developers shall obtain consents to any required easements as necessary. <br />10. License. Developers hereby grant City, its agents and employees, a license to enter any of <br />Developers' property to perform all necessary work, maintenance and /or inspections deemed appropriate by the City <br />during the construction of the improvements. The license shall expire after the improvements are installed pursuant <br />to this Agreement and approved by City. <br />11. Responsibility for Costs. Developers shall pay all costs in conjunction with evaluation, design and <br />construction of the improvements and all the costs incurred by City relating to the preparation of this Agreement, <br />and all reasonable costs and expenses incurred by City in monitoring and inspecting the construction of the public <br />improvements, but not limited to, attorneys' fees, engineering costs, appraisals, City staff time, planning costs, and <br />administrative fees. Costs for City staff time expended in conjunction with this project are expected to equal two <br />and one half percent (2.5 %) of the construction cost of this project as documented by the initial contract.
