Any parcel of land upon which a single family residence was constructed prior to <br />June 25, 1980 shall maintain a minimum five (5) foot interior side yard setback <br />for the principal building, future attached additions to the building, and from any <br />existing or newly created lot lines. In all cases, side yards abutting a public right - <br />of -way shall maintain a thirty (30) foot setback for all buildings. <br />As shown on the submitted certificate of survey, the home in question exhibits a west <br />side yard setback of 5.5 feet. Thus, the setback that previously did not meet the <br />minimum requirement of the ordinance now satisfies such requirements. <br />All proposed lots have been found to meet the minimum area and width requirements of <br />the R -1 zoning district. Additionally, the existing residence meets not only the <br />applicable side yard setback requirements but front and rear yard setback requirements <br />as well. <br />Utility easements have not been shown on the certificate of survey. As a condition of <br />subdivision approval, drainage and utility easements should be illustrated on the survey. <br />The applicant will be required to pay a per lot cash contribution (in lieu of land <br />dedication) for park for the two newly created lots as determined by the Parks and <br />Recreation Commission and approved by City Council. <br />RECOMMENDATION <br />Based on the preceding review, our office recommends approval of the proposed lot <br />split subject to the following conditions <br />1. The certificate of survey be modified to illustrate drainage and utility easements. <br />2. The applicant pay a cash contribution (in lieu of land dedication) for park for the <br />newly created lot as determined by the Parks Commission and approved by City <br />Council. <br />3.
