The outlot follows the alignment of a new access driveway that will serve <br />both the Aldi Foods and the Bally facility to the west. At the time of the City Council's <br />approval of the Aldi project, the Council added a condition of approval that the Bally's <br />pylon sign along Rice Street be brought into conformance as it was allowed to be <br />constructed on a parcel separate from the Bally's building. The applicant's proposal is <br />to create an outlot separate from the Aldi parcel, and combine it with the Bally's parcel, <br />curing the non - conformity. <br />The replat does not affect the function of the site, or change the site plan in any way. <br />However, there are two potential issues raised by this proposal. First, the Council's <br />intention to correct the off -site sign condition did not include direction as to how this <br />might be accomplished. An alternative would be to require the sign to be moved to the <br />existing Bally's property, rather than to re- subdivide. The initial sign construction was <br />for a 67 square foot sign that was allowed off -site through the use of a Conditional Use <br />Permit PUD. The staff report at the time (October, 1998) indicated that the City might <br />use the PUD to restrict or limit additional signage along Rice Street, anticipating that the <br />Bally sign would be permanently located in its current spot. <br />The second issue relates to the recording of the plat, and the possibility that Ramsey <br />County may not allow the property owner (Schroeder) to combine the Outlot A from this <br />plat with the unplatted parcel occupied by Bally's. In this case, the applicants will need <br />to plat the Bally's site together with the new Outlot to combine the parcels. <br />
