Victor Maduilke Oramatu <br />Our File 10287 <br />Dear Kathy: <br />'telephone <br />(651) 222-2541 <br />Facsimile <br />(651) 223-5289 <br />As you and I previously discussed, the prosecution of the above referenced individual was <br />diverted by Ramsey County District Court to Project Remand Inc. Enclosed please find a copy of <br />the letter from Project Remand which indicates that the Defendant admits the violation and also <br />sets forth the conditions which he must comply with. If these conditions are met the criminal <br />matter will be dismissed on February 18, 2004. <br />As you know, section 702.080 of the Little Canada Code indicates that every licensee is <br />responsible for the conduct of any employee in the licensed establishment. As stated above, the <br />Oasis Market employee has admitted the sale of alcohol to a person under the age of twenty -one. <br />Accordingly, pursuant to section 702.110 of the Little Canada Code the council "shall either <br />suspend for up to sixty days or revoke any 3.2 malt liquor license, or impose a civil fine not to <br />exceed $2,000.00 for each violation upon a finding that the licensee has failed to comply with any <br />applicable statute, regulation, or ordinance relating to alcoholic beverages ". <br />As you know, the licensee is entitled to notice followed by a hearing and a written <br />decision of the council. <br />If you have any further questions relative to this matter, please let me know. <br />PJS:chl <br />Enclosure <br />p.2 <br />
