Hanson <br />Access to Property on the West <br />As you will note from the minutes of the May 28th special Planning Commission, there was <br />considerable discussion relative to the issue of providing for development access for the property to <br />the west of this plat. The Planning Commission agreed that access should be provided as <br />recommended by the City Planner as Option B on page 2 of his report attached. The Planning <br />Commission also indicated that the issue of assessments or a fee in lieu of assessments should be <br />addressed in an equitable manner for both the developer and the property owner to the west. <br />City staff is supportive of the Planning Commission's recommendation and further recommends that <br />approvals of the Preliminary and Final Plat should be subject to the developer entering into a <br />development agreement with the City and that this issue be specifically addressed in that <br />development agreement. <br />It should be noted that at the Planning Commission meeting, the developers indicated another option <br />that would shorten the cul -de -sac and eliminate the potential for access by the property to the west. <br />City staff does not support this option as the result will limit development potential for the parcel to <br />the west. <br />City Use Deed <br />The City currently holds a use deed for drainage and utility purposes for a portion of the property that <br />has been included in the Hamel Estates plat (see map attached). The developer has requested that the <br />City reconvey this use deed to the State of Minnesota at which time Ramsey County will sell the <br />parcel to the developer. The City's need for drainage and utility easements in this area is being <br />addressed through the dedication of easements as a part of the platting process. Therefore, it is staff's <br />recommendation that the Council approve the reconveyance of tax-forfeited property to the State of <br />Minnesota for conveyance to the developers of the Hamel Estates plat subject to the developer's <br />simultaneous recording of the plat including the appropriate easements. <br />- 1 2 - <br />
