reasonable attempt was made to give personal notice to all affected property owners, and <br />all persons interested were given an opportunity to be heard; <br />AND WHEREAS, <br />Any person, corporation, or city owning or controlling easements contained upon the <br />property vacated, reserves the right to continue maintaining the same or to enter upon <br />such way or portion thereof vacated to maintain, repair, replace, remove, or otherwise <br />attend thereto; <br />AND WHEREAS, <br />It appears that it will be in the best interest of the City to vacate such utility and drainage <br />easement; <br />AND WHEREAS, <br />Four -fifths of all members of the City Council concur in this resolution; <br />NOW, THEREFORE, BE IT RESOLVED, that the utility and drainage easement as <br />described below is hereby vacated: <br />That part dedicated as Utility and Drainage easement in Lot 3, Block 1, Leibel's <br />Twin Lake Addition, Ramsey County, Minnesota, which lies adjacent and <br />perpendicular to the following described line: <br />Commencing at the southwest corner of said Lot 3; thence North 89 <br />degrees 28 minutes 30 seconds East (assumed hearing), along the south <br />line of said Lot 3 a distance of 6.00 feet to the point of beginning of the <br />line to be described; thence continuing North 89 degrees 28 minutes 30 <br />seconds East along said south line a distance of 170.71 feet to an angle <br />point along the southerly line of said Lot 3; thence North 00 degree 31 <br />minutes 30 seconds West a distance of 20.0 feet to an angle point on said <br />southerly line; thence North 89 degrees 28 minutes 30 seconds East, <br />continuing along said southerly line a distance of 53.50 feet to the <br />southeast corner of said Lot 3 and said line there terminating. <br />EXCEPT the East 6.00 feet thereof <br />- 2 6 - <br />
