Howard R., Green Com <br />June 12, 2003 <br />File: 821450J -0240 <br />Honorable Chair and Planning Commission <br />City of Little Canada <br />515 Little Canada Road East <br />Little Canada, MN 55117 -1633 <br />RE: INMAN ADDITION <br />CITY OF LITTLE CANADA <br />Dear Planning Commission Members: <br />any <br />A response letter was prepared by Mr. Jonathan Faraci of Development Engineering, <br />P.A. in response to my previous comment letter to the Planning Commission dated June <br />6, 2003. In regards to the responses he provided, we would offer the following. <br />Preliminary Plat <br />Item 1) <br />As stated in the previous letter, it would be beneficial for the City to request that the <br />right -of -way for the Leeward Way extension be granted as part of the Inman Addition <br />plat. The City Attorney should be consulted as to the legal ability of the City to require <br />granting of the street right -of -way if Mr. Inman was unwilling to grant the right -of -way as <br />requested. <br />While the Mr. Faraci's letter indicates that the Leeward Way right -of -way may not be <br />granted, it is requested that the City allow the installation of a smaller than standard cul- <br />de -sac at the east end of the new Allen Avenue. It is our opinion that if Mr. Inman is <br />unwilling to grant the right -of -way for the future extension of Leeward Way at this time he <br />may not be willing to grant it at anytime. Therefore the cul -de -sac that is referred to as a <br />temporary condition may in fact be a permanent condition and should then be built to the <br />City standard of a 45 -foot paved radius within a 50 -foot radius right -of -way. If the right - <br />of -way is granted it would be evidence that Mr. Inman is acknowledging the cul -de -sac is <br />a temporary condition and could be built to a smaller than standard size as done with <br />other temporary cul -de -sacs. Another concern associated with not granting the right -of- <br />way at this time is the possibility of a building or other improvement being constructed in <br />the proposed future right -of -way making it more difficult to allow the street to be <br />extended in the future. <br />C:\ windows \TEMP \Ltr - 061203- Pingcomm (Inman Add.).doc <br />
