Hanson <br />MEMORANDUM <br />TO: Mayor Fahey and Members of the City Council <br />FROM: Joel Hanson, City Administrator <br />DATE: April 25, 2003 <br />RE: Accounting Supervisor Position <br />Personnel Policy /At -Will Employment for Department Heads <br />When the Personnel Policy was adopted in July of 1995, provisions were included exempting all <br />Department Heads hired after July 12, 1995 from the Policy. This was the result of discussions of the <br />issue of "At -Will" employment for department heads (minutes attached) and the recommendation of <br />the City Attorney in his letter dated June 1, 1995 (attached) to exclude future department heads from <br />the provisions of the Personnel Policy Handbook. <br />Based on that decision, employment contracts have been entered into between the City and any <br />Department Head hired after July, 1995 (Public Works Director and Building Official). Those <br />employment contracts have been necessary to define conditions of employment, and have included <br />the establishment of department head status and the additional week of vacation subject to <br />satisfactory performance. <br />Based on this research, my previous recommendation to amend the Personnel Policy to convey <br />department head status to both the Building Official and the Accounting Supervisor was in error. <br />First, the existing employment contract with the Building Official already conveys department head <br />status and provides for the additional week of vacation upon satisfactory performance. Second, it <br />would be contradictory to the fact that department heads hired after July, 1995 are exempted from the <br />Personnel Policy to now amend the Policy as I had suggested. <br />Additional Week of Vacation for Department Heads <br />I have researched the 1995 Council workshop minutes relative to one additional week of vacation for <br />Department Heads in recognition for the time worked in excess of 40 hours per week subject to <br />satisfactory performance (minutes attached). As you will note, the discussion focused primarily on <br />the amount of hours worked by the Parks & Recreation Director. <br />
