As noted above, the Personnel Policy provision only applies to Department Heads hired on or before <br />July 12, 1995. Subsequent Department Heads have entered into Employment Contracts with the <br />City, and this provision has been included in those contracts. <br />Accounting Supervisor <br />It would be my recommendation that the Accounting Supervisor be conveyed the status of <br />department head as I feel that both the level of responsibility required of her as well as her <br />performance warrant that status. With the designation of department head, I would further <br />recommend that an additional week of vacation be provided to the Accounting Supervisor subject to <br />satisfactory performance. It should be noted that the Accounting Supervisor regularly works over 40 <br />hours per week in the performance of her duties. As a non - exempt employee, the amount of' <br />compensatory time that she earns in a given year exceeds the additional week of vacation that is <br />being proposed. (To date, she has chosen not to claim it.) <br />I can understand the concern about the ratio of department heads to regular full -time employees, and <br />would suggest that an alternative would be to create categories of employees, i.e. department head, <br />exempt, and non - exempt. If that is the desire of the Council, staff can prepare definitions for each <br />category which would then be included in the Personnel Policy. <br />Should the decision be to make the Accounting Supervisor position an exempt position rather than a <br />department head, it would still be my recommendation to convey the additional week of vacation in <br />recognition of the hours worked in excess of 40. In reviewing the Fair Labor Standards Act (League <br />of Minnesota Cities Fact Sheet #2 attached), it is my feeling that the Accounting Supervisor meets the <br />duties test for an exempt employee under the "Professional Exemption ". <br />Should the Council support my recommendation to make the Accounting Supervisor a department <br />head, then based on past practice, I will prepare an employment agreement between the Accounting <br />Supervisor and the City. If the Council directs an alternative course of action, the specifics can be <br />discussed at Wednesday's meeting. <br />If the Council has any concerns with the Personnel Policy (updated copy has been provided as <br />separate document), I would recommend that a workshop meeting be scheduled to discuss the Policy <br />in detail. <br />If you have any questions or require additional information, please contact me prior to Wednesday's <br />meeting. <br />
