Subsection 903.010.K, of the Zoning Ordinance, allows non - conforming, non - income <br />producing residential units to expand with the purpose of improving livability as a <br />conditional use, provided that the non - conformity of the structure will not be increased. <br />As previously stated this project will reduce the number of bedrooms from eight to five, <br />thereby lessening the non - conformity. The general standards of the zoning ordinance <br />for the consideration of a CUP also apply. In summary, those standards require <br />consistency with the Comprehensive Plan, negligible impacts on surrounding properties <br />in the neighborhood, and negligible impacts on public services and utilities, including <br />transportation. <br />It appears that each of these conditions is being met with the proposed request. The <br />only issues that are unclear from the material turned in with the application are its ability <br />to meet the front yard setback and that the addition matches the architectural character <br />of the current building. As a condition, the applicant should provide a site plan showing <br />its ability to meet the required 30 foot front yard setback requirements for the R -1 <br />District. It should also be listed as a condition that the architectural style and exterior <br />finish materials of the addition match that of the existing structure. <br />RECOMMENDATION <br />The proposed addition is an expansion of an existing non - conforming use that will both <br />improve the livability and lessen the non - conformity in use by reducing the number of <br />non - related people residing within the home. As such, planning staff recommends <br />approval of the Conditional Use Permit subject to the following conditions: <br />1. A site plan be submitted to city staff showing the additions ability to meet <br />the required 30 foot front yard setback requirement. <br />2. The architectural style and exterior finish materials of the addition match <br />that of the existing structure. <br />pc.
