Subsection 903.010.K, of the Zoning Ordinance, allows non - conforming, non - income
producing residential units to expand with the purpose of improving livability as a
conditional use, provided that the non - conformity of the structure will not be increased.
As previously stated this project will reduce the number of bedrooms from eight to five,
thereby lessening the non - conformity. The general standards of the zoning ordinance
for the consideration of a CUP also apply. In summary, those standards require
consistency with the Comprehensive Plan, negligible impacts on surrounding properties
in the neighborhood, and negligible impacts on public services and utilities, including
transportation.
It appears that each of these conditions is being met with the proposed request. The
only issues that are unclear from the material turned in with the application are its ability
to meet the front yard setback and that the addition matches the architectural character
of the current building. As a condition, the applicant should provide a site plan showing
its ability to meet the required 30 foot front yard setback requirements for the R -1
District. It should also be listed as a condition that the architectural style and exterior
finish materials of the addition match that of the existing structure.
RECOMMENDATION
The proposed addition is an expansion of an existing non - conforming use that will both
improve the livability and lessen the non - conformity in use by reducing the number of
non - related people residing within the home. As such, planning staff recommends
approval of the Conditional Use Permit subject to the following conditions:
1. A site plan be submitted to city staff showing the additions ability to meet
the required 30 foot front yard setback requirement.
2. The architectural style and exterior finish materials of the addition match
that of the existing structure.
pc.
