5. Facilities. Lessee shall use the concession stand existing at the time of <br />entering into this Agreement. Any improvements to or expansion of the <br />concession stand shall be made at the sole cost of Lessee and shall not be <br />made without the prior approval of the Parks and Recreation Director. Lessee <br />shall purchase and maintain any additional equipment (other than City owned <br />equipment presently on site) needed to operate the concession stand. Lessee <br />understands that the City makes no warranties, expressed or implied, relating <br />to the concession stand, and that the concession stand is to be leased in an "AS <br />IS" condition. <br />6. Licenses and Permits. Lessee shall be responsible for securing and paying for <br />all licenses, permits, and fees required by the City, County, or State. <br />7. Insurance. Lessee shall provide comprehensive general liability insurance <br />coverage in an amount of at least $1,000,000 for each occurrence of bodily <br />injury or property damage. The City shall be named as an additional insured <br />on said policy and said policy shall indicate that the policy will not be <br />cancelled without at least ten (10) days prior written notice to the City. In <br />addition, Lessee shall secure statutory worker's compensation insurance <br />coverage for any employees and shall provide a copy of the certificate of such <br />insurance to the City. <br />8. Indemnification. Lessee shall indemnify and hold the City harmless from and <br />against any and all costs, liability, damages, and claims of damage including, <br />but not limited to claims for personal injury or property damage which may <br />arise by reason of any act of the Lessee or any of its employees, independent <br />El: \KrisP\ Parks & Recreation \Miscellaneous \Concessions Agreementdoc <br />Page 2 of 4 <br />
