MINUTES <br />CITY COUNCIL <br />JANUARY 22, 2003 <br />Fahey noted that the general idea is to vacation excess right-of-way and <br />put property back on the tax rolls. Therefore, he suggested that the <br />vacation extend from Savage Lane to Morrison Avenue. The <br />Administrator agreed that that was an option. He noted that determining <br />the location of the pavement within the right -of -way prior to taking action <br />was a good one. The Administrator also noted that in this particular <br />situation the west end of Rose Place is undeveloped given the steep hill in <br />this area. Therefore, the hill could become a defining point for <br />determining the distance for the vacation. <br />Blesener asked what impact the vacation would have on the Buche <br />driveway. <br />Fahey suggested that the City Attorney research the history of the property <br />determining where the right -of -way came from. He also suggested that <br />the City Engineer to a site inspection and determine the location of the <br />pavement as well as the Buche driveway in relation to the right -of -way. <br />Fahey asked Derek Anderson why he would prefer to have five feet of <br />right -of -way vacated on either side of Rose Place. Derek Anderson <br />replied that the five feet of additional property would provide him with <br />more options should he ever want to expand his garage. <br />Joe Buche indicated that he, too, would prefer that the five feet of right-of- <br />way be vacated on either side of the street. <br />Derek Anderson indicated that in clearing his land, Mr. Roberto cut down <br />a tree that fell and knocked down two trees on the City's right -of -way. <br />Derek Anderson stated that these trees provided screening for his property <br />and he would like them to be replaced. Derek Anderson also asked for <br />assurances that no additional clearing of the right -of -way would occur. <br />Fahey pointed out that the City does not require the screening of one <br />residential house from another. Fahey also noted that the City does not <br />favor the planting of trees within the road right -of -way. Typically road <br />rights -of -way are kept clear of trees. <br />Derek Anderson indicated that these trees were a screening issue for him <br />and suggested that if they City prefers they not be replaced on the right -of- <br />way, that Mr. Roberto plant them on Derek Anderson's property. <br />Joe Buche, Jr. pointed out that there is a thick area of screening on the <br />right -of -way and asked what would prevent N[r. Roberto from removing <br />more trees in this area. Fahey again stated that trees in any portion of a <br />road right -of -way are inconsistent with its intended use. <br />7 <br />
