MINUTES <br />CITY COUNCIL <br />JANUARY 22, 2003 <br />Matt Anderson stated that in response to the neighbors concern, Mr. <br />Roberto cannot just go onto a City road right -of -way and cut down trees. <br />Fahey stated that the City will not give Mr. Roberto permission to cut any <br />trees down in the right -of -way. <br />Blesener pointed out that this is another reason to have the exact right -of- <br />way location defined. <br />Fahey pointed out that if trees on the right -of -way were interfering with <br />Mr. Buche's access to his property, he would not be opposed to Mr. Buche <br />clearing the trees that were in the way. <br />Joe Buche Jr. contended that Mr. Roberto was cutting down trees on the <br />right -of -way rather than on his own property. Mr. Roberto disagreed. <br />Fahey stated that he was not interested in requiring Mr. Roberto to replace <br />the two trees that were knocked down. Blesener indicated that in viewing <br />the property, it appeared to him that Mr. Roberto was removing trees so <br />that he could build his house. <br />The City Administrator indicated that Mr. Roberto should not remove any <br />trees from the right -of -way. <br />Derek Anderson indicated that he has no problem with Mr. Roberto <br />constructing his house. His concern was to protect the screening that is in <br />place. Blesener indicated that Mr. Roberto does have a right to have a <br />yard. <br />Roberto indicated that it was his belief that the trees he cut down were on <br />his property. One did topple and knock down two trees on the City's <br />right -of -way. Roberto indicated that he will leave as many trees on his <br />property as possible, and is aware of the City's Tree Replacement <br />Ordinance and his need to comply with it. <br />Carol Stenger indicated that she was concerned about the way Mr. Roberto <br />was cutting the trees pointing out that some fell across the road and <br />created safety concerns. Stenger recommended that any trees that are <br />removed should be removed in a safe manner. <br />There was no one present from the general public wishing to comment on <br />this matter. <br />Upon motion by Fahey, seconded by LaValle, the public hearing was <br />closed. <br />8 <br />
