2 <br />•A detached accessory building with a footprint of approximately 1,512 square feet, exceeding <br />the maximum by-right allowance of 1,500 square feet. <br />•A detached accessory structure with a height of approximately 20 feet 4 inches, exceeding the <br />maximum by-right height of 18 feet or the height of the principal structure, whichever is less. <br />o The principal structure is 15 feet 11 inches in height. <br />•Use of post-frame construction and finished metal exterior materials, which require Conditional <br />Use Permit approval under the City’s zoning regulations. <br />The proposed structure would be constructed on a continuous foundation and used for private, year- <br />round indoor recreational activities by the household. <br />Request of the Council <br />The applicant is requesting approval of a Conditional Use Permit for a residential detached accessory <br />structure. <br />A Conditional Use Permit is a discretionary approval that allows certain uses or development features <br />that are permitted under the City Code only when specific criteria are met. Unlike by-right <br />development, a Conditional Use Permit requires the Planning Commission and City Council to <br />evaluate whether a proposal is compatible with its surroundings and consistent with the intent of the <br />zoning regulations. Unlike a variance, a Conditional Use Permit addresses uses or development <br />features that are allowed by the City Code, subject to site-specific review. Approval may include <br />conditions to mitigate impacts, ensure compatibility, or address site-specific circumstances. <br />The applicable standards and detailed analysis of the proposal’s compliance with those standards are <br />provided in Attachment A – Planning and Zoning Analysis Memo, which is intended to serve as the <br />technical record for the application. <br />Relevant City Code Sections <br />The following sections of the City Code are applicable to this request: <br />1.Chapter 904, Table 904-6 <br />2.Section 914.130 <br />3.Section 915.020 <br />4.Section 917.070 <br />Outside Agency Review <br />Because the proposed project would disturb less than 20,000 square feet of land and the property is not <br />located on a County roadway, no outside agency review is required. The City’s Building Official <br />reviewed the application materials in coordination with the Community Development Director and <br />identified no immediate concerns. The Building Official noted that final construction plans will be <br />required to be stamped by a licensed design professional due to the structure being an occupiable <br />space. <br />Public Comment
