<br /> <br />3 <br /> <br />Staff mailed notice of the Conditional Use Permit request to all property owners and occupants within <br />350 feet of the subject property. Notice was also published in the Pioneer Press on Tuesday, February <br />3, 2026, in accordance with statutory requirements. <br /> <br />As of the date of this report, staff have received no written public comments. <br /> <br /> <br />Planning Commission <br />At their 2/12/2026 meeting, the Planning Commission unanimously recommended the proposal be <br />approved by the City Council. The Commission discussed the proposed materials, landscaping, and the <br />overall compatibility of the structure. Ultimately the Commission determined that the proposed <br />structure is compatible with the surrounding neighborhood and the house on the property. They <br />discussed screening but determined that a fence would not provide any visual screening and that <br />requiring additional landscaping is unnecessary given the proposed locations distance from all nearby <br />homes. <br /> <br />The proposed conditions at the end of this report reflect the Planning Commission’s discussion and <br />determination. <br /> <br />Applicant Narrative <br />In their submitted narrative, the applicants state that they are requesting a Conditional Use Permit to <br />construct a detached accessory structure intended to serve as a year-round indoor recreational space for <br />their household. They describe the structure as a means of supporting indoor sports activities for their <br />children, including basketball, volleyball, and pickleball, particularly during winter months. The <br />applicants explain that the requested height and square footage are necessary to accommodate adequate <br />interior clearances for these activities. <br /> <br />The applicants further state that they evaluated alternative options, including an outdoor sport court <br />and an attached addition to the existing home. They concluded that an indoor detached structure would <br />better mitigate potential noise, lighting, and visual impacts compared to an outdoor court, and would <br />be less impactful to neighboring properties than a taller attached addition placed closer to adjacent <br />homes. The narrative emphasizes rear-yard placement, use of existing grade differences to reduce <br />apparent height, orientation of windows toward the principal structure, matching exterior colors, <br />landscaping, and the absence of increased traffic or parking demand as measures intended to reduce <br />neighborhood impacts. <br /> <br />Staff Findings <br />Staff focus on the primary questions and considerations relevant to the Planning Commission’s review <br />of the application in this section. A more detailed evaluation of the proposal and applicable standards <br />is provided in Attachment A – Planning and Zoning Analysis Memo. <br /> <br />There are three Conditional Use Permit criteria that relate most clearly to this proposal: <br />1. Any request to use otherwise prohibited materials shall demonstrate a functional relationship <br />between the material and the proposed use of the building or structure, and all such materials <br />shall be finished and durable <br />2. Screening shall be provided where required by the City Council to mitigate visual impacts and <br />shall consist of fencing, landscaping, or a combination thereof
