2 <br /> <br />WHEREAS, the proposed post-frame construction and finished metal exterior <br />materials demonstrate a functional relationship to the intended indoor recreational use of <br />the structure and are eligible for approval through the Conditional Use Permit process; and <br /> <br />WHEREAS, the scale, orientation, and placement of the structure, when evaluated <br />in the context of the lot size, rear-yard placement, and existing grade differences on the <br />site, are compatible with the principal structure and surrounding properties, subject to the <br />conditions contained herein; and <br /> <br />WHEREAS, the Conditional Use will not impede the normal and orderly use or <br />development of nearby property, substantially diminish nearby property values, or place <br />an undue burden on public facilities or services; and <br /> <br />WHEREAS, the Conditional Use will not be detrimental to the health, safety, or <br />welfare of the public; and <br /> <br />WHEREAS, the Conditional Use will not result in a nuisance by emissions; and <br /> <br />WHEREAS, the Conditional Use will not unduly affect natural features; <br /> <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF LITTLE CANADA, MINNESOTA, AS FOLLOWS: <br /> <br />The Conditional Use Permit for a detached accessory building at 2912 Vanderbie Street is <br />hereby approved, subject to the following conditions: <br /> <br />1. Development authorized by this Conditional Use Permit shall not commence until <br />the applicant has obtained all other approvals required by the City Code or any <br />other applicable regulations. Approval of this Conditional Use Permit does not <br />constitute approval of any other required permit, including a building permit.. <br /> <br />2. Development authorized by this Conditional Use Permit shall be substantially <br />consistent with the plans, elevations, and materials submitted with the application. <br />Any material deviation from the approved plans shall require City review and <br />approval and may require an amended or new Conditional Use Permit. <br /> <br />3. This Conditional Use Permit shall apply only to the specific detached accessory <br />building approved under this application and shall not authorize the construction <br />of any additional structures on the property. <br /> <br />4. Prior to issuance of a building permit, the applicant shall submit a site plan <br />prepared by a licensed surveyor demonstrating compliance with minimum side <br />and rear yard setbacks of five feet and documenting all existing and proposed
