822-1 <br /> <br />822. TATOO/BODY ART. <br /> <br /> <br />821.010. PURPOSE AND INTENT. It is the purpose of this Section to regulate the <br />operation of tattoo parlors, body piercing, body art, and similar establishments within the City in <br />order to ensure that such establishments are operated in a sanitary and orderly fashion, and do <br />not become a threat to public health, safety, or general welfare. <br /> <br /> 821.015. ADOPTION OF STATE LAW BY REFERENCE. The provisions of <br />Minnesota Statute Chapter 146B Body Art are hereby adopted by reference and are made a part <br />of this article as if set out in full. It is the intention of the Council that all future amendments of <br />Minnesota Statute Chapter 146B are hereby adopted by reference or referenced as if they had <br />been in existence at the time this article was adopted. Minnesota Statute Chapter 146B is hereby <br />modified by deleting the term "commissioner" and substituting the term "or other authorized by <br />the City Council" in place thereof. <br /> <br />821.020. LOCATIONS. Establishments subject to this Section shall only be allowed in <br />those zoning districts as specified in the Little Canada Zoning Ordinance, Chapter 900 of the <br />City Code. <br /> <br />821.030. LICENSE REQUIRED. In addition to any zoning approvals, each <br />establishment subject to this section shall be required to obtain a license from the City Clerk. No <br />such license shall be issued until approved by the City Council, or until the City Council has <br />approved all necessary zoning requirements. The City Council may add conditions to the <br />approval of the license as necessary to enforce the intent of this Section. <br /> <br />821.040. LICENSE CONDITIONS. Approval of a license under this Section shall only <br />be granted when the applicant for such license has been found to comply with the following <br />conditions, and any other conditions added by the City Council: <br /> <br />A. The license shall be required for tattooing, body piercing, and other body art <br />establishments, with the exception of ear piercing as an accessory use to jewelry <br />sales. <br /> <br />B. The license shall provide for clean and sanitary conditions of the premises at all <br />times. <br /> <br />C. The license applicant and any employees engaging in tattooing, body piercing, or <br />body art shall be subject to a successful criminal background check. <br /> <br />D. At the time of license application, as well as at the time of each subsequent license <br />renewal, the license holder shall be required to provide a copy of a valid State of <br />Minnesota Body Art Technician and/or Establishment license. <br /> <br />E. The use shall operate only between the hours of 7:00 a.m. and 11:00 p.m. <br />
