CITY OF LITTLE CANADA RAMSEY COUNTY STATE OF MINNESOTA ORDINANCE NO. 932 ORDINANCE AMENDING LITTLE CANADA CITY CODE CHAPTER 822, TATTOO-BODY ART The City Council of the City of Little Canada, Ramsey County, Minnesota does hereby ordain: SECTION 1. The City Council of the City of Little Canada hereby amends Chapter 822 of the Little Canada Municipal Code by adding the underlined material and deleting the stricken material as follows: 822. TATOO/BODY ART. 822.010. PURPOSE AND INTENT. It is the purpose of this Section to regulate the operation of tattoo parlors, tattoo shops, body piercing, body art, and similar establishments within the city in order to ensure that such establishments are operated in a sanitary and orderly fashion, and do not become a threat to public health, safety, or general welfare. 822.011 DEFINITION. Tattoo parlor, tattoo shop: any room or space where tattooing (body art) or body piercing is performed, not including beauty salons or cosmetology businesses involving ear piercing. 822.015. ADOPTION OF STATE LAW BY REFERENCE. The provisions of Minnesota Statute Chapter 146B Body Art are hereby adopted by reference and are made a part of this article as if set out in full. It is the intention of the Council that all future amendments of Minnesota Statute Chapter 146B are hereby adopted by reference or referenced as if they had been in existence at the time this article was adopted. Minnesota Statute Chapter 146B is hereby modified by deleting the term "commissioner" and substituting the term "or other authorized by the City Council" in place thereof. 822.020. LOCATIONS. Establishments subject to this Section shall only be allowed in those zoning districts as specified in the Little Canada Zoning Ordinance, Chapter 900 of the City Code. 822.030. LICENSE REQUIRED. In addition to any zoning approvals, each establishment subject to this section shall be required to obtain a license from the City Clerk. No such license shall be issued until approved by the City Council, or until the City Council has approved all necessary zoning requirements. The City Council may add conditions to the approval of the license as necessary to enforce the intent of this Section. 822.040. LICENSE CONDITIONS. Approval of a license under this Section shall only be granted when the applicant for such license has been found to comply with the following conditions, and any other conditions added by the City Council: A. The license shall be required for tattooing, body piercing, and other body art establishments, with the exception of ear piercing as an accessory use to jewelry sales. B. The license shall provide for clean and sanitary conditions of the premises at all times.
