Submission of a proposal constitutes acceptance of the City’s Professional Services Agreement <br />without material exception. Proposers may identify requested modifications in their proposal; <br />however, the City reserves the right to reject proposals that include substantial or unacceptable <br />contract exceptions. <br />Budget Compliance Requirement <br />The proposer shall design the project to remain within the approved project budget. If, at any <br />time during the design phases, cost estimates prepared by the consultant team indicate that the <br />project exceeds the approved budget, the proposer shall revise the design, at no additional cost <br />to the City, to bring the project back into compliance. <br />Ownership of Documents <br />All drawings, specifications, reports, and other documents prepared by the proposer under this <br />contract shall become the property of the City of Little Canada upon completion or termination <br />of the agreement, subject to standard professional use limitations. <br />Insurance Requirements Summary <br />The selected proposer shall be required to maintain insurance coverage meeting the City’s <br />standard requirements throughout the duration of the project. Coverage shall include, but not <br />be limited to: <br />• Commercial General Liability <br />• Workers’ Compensation <br />• Professional Liability (Errors and Omissions) <br />• Automobile Liability <br />Specific coverage limits and policy requirements will be outlined in the City’s Professional <br />Services Agreement. <br />City Rights and Reservations <br />The City of Little Canada reserves the right to: <br />• Reject any or all proposals <br />• Waive informalities or minor irregularities <br />• Request clarification or additional information <br />• Conduct interviews or request presentations
