Staff Report <br />To: Mayor Fischer and Members of the City Council <br />From: Bryce Shearen, City Administrator <br />Date: March 25, 2026 <br />Re: Councilmember Resignation <br />Action To Be Considered: <br />Motion to approve, table, or deny the following: <br />•Acceptance of Councilmember Gutierrez's resignation and declare a vacancy on the City <br />Council. <br />Background: <br />Councilmember Gutierrez has submitted her resignation from the City Council effective <br />immediately. Gutierrez’s term does not end until December 31, 2026, so a new Council member <br />should be appointed to fill the remainder of the term. <br />Council has discretion on filling the position. Cities may advertise the opening, require an <br />application, or request letters of interest. However, appointments may also be made informally <br />based on individuals the council already knows to be interested in the position. If the council (or <br />a quorum or committee of the council) conducts the interviews, the Open Meeting Law applies. <br />Staff recommends that the Council discuss and provide direction on the process and timeline for <br />filling the vacancy. <br />Eligibility and Process: <br />The council may appoint any individual who is eligible for election to that office. Generally, to <br />be eligible, a person must be a U.S. citizen, a resident of the city, a qualified city voter, and at <br />least 21 years old. <br />The council is not obligated to appoint any candidate previously defeated in an election for the <br />office. <br />To fill the vacancy, a majority vote is needed for the appointment. If the vote is a tie, the mayor <br />can appoint any qualified person willing to fill the vacancy, even if that person was not the <br />subject of the original appointment vote. <br />Staff Recommendations: <br />Staff recommends approving the resolution accepting Amanda Gutierezz’s resignation effective <br />immediately and declaring a vacancy on the City Council. Additionally, staff recommends that <br />the Council provide direction on the process and timeline for filling the vacancy.
