2 <br /> <br />WHEREAS, the proposal demonstrates a genuine security need for the proposed <br />security fence. <br /> <br />WHEREAS, the Conditional Use will not impede the normal and orderly use or <br />development of nearby property, substantially diminish nearby property values, or place <br />an undue burden on public facilities or services; and <br /> <br />WHEREAS, the Conditional Use will not be detrimental to the health, safety, or <br />welfare of the public; and <br /> <br />WHEREAS, the Conditional Use will not result in a nuisance by emissions; and <br /> <br />WHEREAS, the Conditional Use will not unduly affect natural features; <br /> <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF LITTLE CANADA, MINNESOTA, AS FOLLOWS: <br /> <br />The Conditional Use Permit for a commercial telecommunications tower and security fence <br />at 2617 Park Street is hereby approved, subject to the following conditions: <br /> <br />1. Development authorized by this Conditional Use Permit shall not commence until <br />the applicant has obtained all other approvals required by the City Code or any <br />other applicable regulations. Approval of this Conditional Use Permit does not <br />constitute approval of any other required permit, including a building permit. <br /> <br />2. Development authorized by this Conditional Use Permit shall be substantially <br />consistent with the plans, elevations, and materials submitted with the application. <br />Any material deviation from the approved plans shall require City review and <br />approval and may require an amended or new Conditional Use Permit. <br /> <br />3. This Conditional Use Permit shall apply only to the specific telecommunications <br />tower and associated accessories approved under this application and shall not <br />authorize the construction of any additional structures on the property. <br /> <br />4. The applicant is responsible for receiving any required federal, state or local <br />agency licenses required for the construction or operation of the tower. <br /> <br />5. No advertising message shall be affixed to the tower. <br /> <br />6. The tower shall be constructed to conform with the requirements of the <br />Occupational Safety and Health Administration. <br /> <br />7. The tower shall remain in compliance with all Minnesota building and electrical <br />code requirements.
