Agreement PW2026-13 <br />PW 2026PW-13 Page 2 of 8 <br />7.The Project is led by the City in partnership with the County and Mn/DOT. <br />8.A separate three-party Cooperative Agreement between the City, County, and <br />Mn/DOT will outline construction cost sharing and long-term maintenance <br />responsibilities of the improvements. The three-party agreement will not <br />address cost sharing provisions described herein. <br />AGREEMENTS <br />1.Responsibility for Design Engineering <br />1.1.Plans, specifications, and proposals will be prepared in accordance with <br />Mn/DOT State Aid and Federal Aid requirements. <br />2.Procurement and Award of Contract <br />2.1.The City will take bids in accordance with state law and City procedures. <br />2.2.The City will prepare an abstract of bids and a cost participation summary based <br />on the lowest responsible bidder’s proposal, and will provide the same to the <br />County. <br />2.3.The City will request the County’s concurrence to award a contract to the lowest <br />responsible bidder. <br />3.Responsibility for Construction Engineering <br />3.1.The City shall perform or contract the performance of the construction <br />engineering for all elements of the Project. <br />4.Project Costs <br />4.1.Right-of-Way Acquisition Costs <br />4.1.1.The County shall pay the City for right-of-way acquisition costs equal to <br />50% of the land costs, indirect costs, and legal costs for Funding Groups <br />A, B, C, and D. <br />4.1.2.The City is 100% responsible for right-of-way acquisition costs for Funding <br />Groups E and F. <br />4.1.3.Right-of-way acquisition costs are estimated based on estimates and <br />percentages but will be invoiced based on actual costs incurred. <br />4.2.Design Engineering Costs <br />4.2.1.The County shall pay the City a design engineering fee equal to 50% of <br />the 13% design engineering fee for Funding Groups A, B, C, and D. <br />4.2.2.The City is 100% responsible for design engineering fees for Funding <br />Groups E and F.
