Agreement PW2026-13 PW 2026PW-13 Page 2 of 8 7.The Project is led by the City in partnership with the County and Mn/DOT. 8.A separate three-party Cooperative Agreement between the City, County, and Mn/DOT will outline construction cost sharing and long-term maintenance responsibilities of the improvements. The three-party agreement will not address cost sharing provisions described herein. AGREEMENTS 1.Responsibility for Design Engineering 1.1.Plans, specifications, and proposals will be prepared in accordance with Mn/DOT State Aid and Federal Aid requirements. 2.Procurement and Award of Contract 2.1.The City will take bids in accordance with state law and City procedures. 2.2.The City will prepare an abstract of bids and a cost participation summary based on the lowest responsible bidder’s proposal, and will provide the same to the County. 2.3.The City will request the County’s concurrence to award a contract to the lowest responsible bidder. 3.Responsibility for Construction Engineering 3.1.The City shall perform or contract the performance of the construction engineering for all elements of the Project. 4.Project Costs 4.1.Right-of-Way Acquisition Costs 4.1.1.The County shall pay the City for right-of-way acquisition costs equal to 50% of the land costs, indirect costs, and legal costs for Funding Groups A, B, C, and D. 4.1.2.The City is 100% responsible for right-of-way acquisition costs for Funding Groups E and F. 4.1.3.Right-of-way acquisition costs are estimated based on estimates and percentages but will be invoiced based on actual costs incurred. 4.2.Design Engineering Costs 4.2.1.The County shall pay the City a design engineering fee equal to 50% of the 13% design engineering fee for Funding Groups A, B, C, and D. 4.2.2.The City is 100% responsible for design engineering fees for Funding Groups E and F.
