Mr. Hanson <br />June 21, 2000 <br />Page Two <br />M.S. §505.1793, entitled "Proposed right-of-way acquisitions by local authorities; filing <br />for record ", a copy of which is enclosed, provides another method of delineating future right -of- <br />way. This may be the procedure referred to by Terry Maurer. M.S. §505.1793, Subd. 1, provides <br />in part that the governing body may file for record a map or plat showing right -of -way and other <br />rights or interests in line to be acquired as the governing body determines necessary. <br />M.S. §505.1793, Subd. 4, entitled "No effect on title ", provides as follows: "Maps or plats filed <br />for record under this section do not operate of themselves to transfer title to the property <br />described and designated by appropriate parcel number, but the maps or plats are to be used for <br />delineation purposes." Therefore, the City would have to acquire the property through <br />negotiations or by exercise of the power of eminent domain. <br />Would you please review the enclosed.
