Currently, the parcel has a house <br />without a garage on the property. The existing home is setback more than fifty feet from <br />the street. <br />The existing home is forty feet wide, and is situated on the 75 foot wide parcel with a ten <br />foot setback to the south, and a 24.5 foot setback to the north. The applicant is requesting <br />a variance to permit the construction of a 19.5 foot wide by 24 foot deep garage on the <br />north side, leaving a five foot setback, five feet short of the required 10 foot side yard. The <br />zoning ordinance includes a provision that permits a five foot side yard setback on <br />property in which the house was constructed prior to 1980 when the setback was changed <br />from five feet to ten feet. This house was constructed a few years after that change. <br />Variances are evaluated based on whether there is a physical hardship which interferes <br />with reasonable use of the property. Typically, it is important to find that the proposed use <br />is a reasonable one for the property in question. Second, it is then necessary to find that <br />it is not practical or possible to locate the proposed use in a manner that is conforming with <br />the zoning ordinance. <br />The proposed use is an attached two car garage. No other garage exists on the site. The <br />zoning ordinance states that room must be left on single family lots for a two car garage <br />when a home is built. However, when this home was constructed in the early 1980s, <br />limited space was provided to meet this standard. The applicant is requesting approval <br />Page 45 <br />
