Hanson <br />City Administrator <br />515 Little Canada Road <br />Little Canada, MN 55117 <br />Re: Prohibited Days for Off -Sale Liquor Sales <br />Our File No. 9781 <br />Dear Joel: <br />Telephone <br />(651) 222.2841 <br />Facsimile <br />(651) 223-5289 <br />The days of sale of intoxicating liquor for off - premise consumption is regulated by Minn. <br />Stat. §340A.504, Subd. 4 (1996), which provides, in part, as follows: <br />No sale of intoxicating liquor may.be.made.by an off -sale licensee: <br />(1) on Sunday; <br />(5) on Thanksgiving day; <br />(6) en Christmas day, December 25 ... . <br />Section 703.140(2) of the Little Canada Code prohibits "off- sale" on New Year's day, in <br />addition to Thanksgiving day and Christmas day. <br />In A/AL, INC., et al vs. City of Faribault, the Minnesota Court of Appeals held that the <br />City of Faribault could not prohibit "off- sale'', except on Sundays, Thanksgiving day, or <br />Christmas day. Therefore, the Little Canada restriction on "off-sale" on New Year's day would <br />not be enforceable. <br />Would you please submit this matter to the Council for their consideration.
