MINUTES <br />PLANNING COMMISSION <br />JUNE 14, 2012 <br />Duray noted that there is an existing shed on one of the proposed lots. <br />Brown noted the Planner's comments relative to the shed which indicated <br />that the shed will have to be removed at the time the plat is recorded. The <br />shed would only be allowed to remain if a building permit was <br />immediately applied for for that particular lot. Knudsen indicated that that <br />was correct as the City cannot have an accessory building on a lot without <br />a primary building. The Planner concurred, <br />Knudsen asked about the City Engineer's drainage recommendations. <br />Brown noted that the City Engineer is recommending a rain water garden <br />between Lots 1 and 2 along Yorkton Ridge. A rain water garden is also <br />recommended within the existing easement on Condit Street at the <br />southeast corner of the lot. Brown anticipated that whoever constructs the <br />homes on the new lots would be required to install the rainwater garden as <br />part of the building permit process. <br />Knudsen asked if there were any concern with the City Planner's and <br />City Engineer's recommendations. Brown replied that there were not, but <br />wanted to clarify that the City's ordinance allows for removal of trees up <br />to 30% of the lot coverage. Anything beyond that amount would have to <br />be replaced. The City Planner indicated that up to 30% tree removal is <br />allowed in order to accommodate a house and driveway. Beyond that tree <br />replacement requirements come into play. The Planner noted, however, <br />that trees less than 6 -inch caliper and nuisance species can be reproved <br />without triggering tree replacement requirements. <br />Fischer reported that he looked on the County's web site as well as an <br />Edina Realty sales brochure for this property, and there seems to be some <br />discrepancy in the amount of frontage that this property has on Yorkton <br />Ridge. Brown reported that the property was surveyed thus verifying the <br />footage that is reflected in the proposed plat. The City Planner indicated <br />that realtor information is not always accurate. <br />Duray noted the Planner's recommendation relative to a Development <br />Agreement. Brown noted that the plat creates two new lots for a total of <br />three single- family lots. There is no infrastructure development required. <br />Brown indicated that while there is no objection to entering into a <br />Development Agreement, she was not sure what it would address. The <br />City Planner noted that his recommendation is that the need for the <br />Development Agreement would be at the discretion of the City <br />Administrator. Brown stated that they were agreeable. <br />David Nydegger, Yorkton Ridge, reported that his house is adjacent to the <br />proposed Lot 1. Nydegger stated that he was in support of the proposal <br />and welcomed the cleaning up of the property. I-Ie indicated that most of <br />the trees on proposed Lot 1 are scrub trees or dead and did not think there <br />- 2 - <br />12 <br />
