DEVELOPMENT CONTRACT <br />AGREEMENT, dated September 26, 2001, by and between the CITY OF LITTLE <br />CANADA, a Minnesota municipal corporation, ( "City ") and Richard T. Kimmes <br />( "Developer "). <br />1. Request for Improvement. The Developer has requested the City to <br />allow the construction of sanitary sewer, storm sewer, with retention <br />ponding, water main, curb and gutter, bituminous streets, signage, and <br />lighting necessary to serve and provide access to the Gilanderi Addition <br />plat within the City of Little Canada, as shown on Exhibit "A ". <br />The improvements are necessary to provide access and utilities to the <br />proposed residential subdivision as shown on Exhibit "A ". <br />2. Conditions of Approval. The City hereby approves construction of <br />necessary extensions /additions of sanitary sewer, storm sewer, with <br />retention ponding, water main, curb and gutter, bituminous streets, <br />signage, and lighting to serve the subdivision as shown on Exhibit "A ", <br />conditioned upon the Developer entering into this Agreement and <br />guaranteeing compliance with terms of this Agreement. <br />3. Compliance with Laws and Regulations. The Developer represents <br />to the City that to the best of their knowledge the construction of <br />improvements to serve the proposed subdivision as shown on Exhibit "A" will <br />comply with all City, County, Metropolitan, State and Federal laws and <br />regulations, including, but not limited to, subdivision ordinances, zoning <br />ordinances, noise ordinances, burying of all utilities and environmental <br />regulations; including wetland impact and mitigation.
