Hanson, City Administrator <br />DATE: August 17, 2001 <br />RE: PUD Permit for 2945 Country Drive <br />In reading the Planning Commission minutes relative to the above referenced topic, I <br />thought I should clarify the following issues: <br />• Mr. Bougie commented about the need for 17 feet of additional right -of -way on <br />Condit Street. I did inform him during a discussion we were having regarding the <br />potential subdivision of his property that it was very likely we would require the <br />dedication of 17 feet of right -of -way from his property for Condit Street as a <br />condition of subdivision approval. (Currently only 33 feet of right -of -way exists <br />between Yorkton Ridge and Nadeau Road.) The basis for my statement can best be <br />understood by looking at the attached map. Additional right -of -way from Condit <br />Street would logically come from the west side given current right -of -way <br />alignments. <br />• Mr. Zoch commented about the need for an additional 17 feet of right -of -way from <br />his property. I have never made such a statement to him as 17 feet of right -of -way <br />was dedicated from their property back in the late 1980's. This provided the 50 feet <br />of right -of -way we desire for a public street. No additional right -of -way is needed <br />from the Zoch's or properties to the north of Yorkton Ridge. <br />• Statements were also made regarding Dick Biagini's construction activities occurring <br />before 7 a.m. I believe we were very responsive to those complaints in that we <br />informed the developer of the City's noise ordinance and asked him to ensure <br />compliance. We also told the complainants they should call the Sheriff's Department <br />if violations continued. We also informed the developer that he was not to use Condit <br />Street for construction traffic access. Based on the comments of the neighborhood it <br />appears Mr. Biagini's contractors ignored that request. <br />• The neighborhood is also concerned about the weeds growing in Mr. Biagini's berm <br />along Condit Street. As you know, a condition of approval for Mr. Biagini's second <br />building was that this problem be corrected with that construction. Given his default <br />page 29 <br />
