MINUTES CITY COUNCIL JANUARY 25, 1995 Mrs. Scalze introduced the following resolution and moved its adoption: RESOLUTION NO. 95 -1 -22 - APPROVING THE REZONING OF CERTAIN PROPERTIES ON MINNESOTA AVENUE FROM R -1 TO R -2 AND FROM B -3 TO R -2 AS REQUESTED BY MASTERPIECE HOMES FOR PLAT KNOWN AS COBBLESTONE VILLAGE The foregoing resolution was duly seconded by Morelan. Ayes (5) Scalze, Morelan, Fahey, Pedersen, LaValle. Nays (0). Resolution declared adopted. Mrs. Scalze introduced the following resolution and moved its adoption: RESOLUTION NO. 95 -1 -23 - APPROVING THE PLANNED UNIT DEVELOPMENT TO ALLOW INDIVIDUAL UNITS AND COMMON OPEN SPACE AS PART OF THE PLAT FOR COBBLESTONE VILLAGE AS REQUESTED BY MASTERPIECE HOMES CONTINGENT UPON COMPLIANCE WITH THE RECOMMENDATIONS OF THE CITY PLANNER, CITY ENGINEER, AND CITY STAFF The foregoing resolution was duly seconded by LaValle. Ayes (5) Scalze, LaValle, Pedersen, Morelan, Fainey. Nays (0). Resolution declared adopted. The City Administrator recommended that the two building permits requested by Mr. Howe could be issued once the City has a development agreement with Mr. Howe for this plat and once sufficient improvements are in place to serve the two structures. The Administrator pointed out that Code says that a minimum of the first lift of blacktop must be in place before building permits can be issues. However, the City has issued building permits for other developments' prior to that if a development agreement is in place.' The development agreement will be drafted and submitted to the Council for approval. Mr. LaValle introduced the following resolution and moved its adoption: RESOLUTION NO. 96 -1 -24 - APPROVING THE FINAL PLAT FOR COBBLESTONE VILLAGE AS REQUESTED BY MASTERPIECE HOMES CONTINGENT UPON THE DEVELOPER ENTERING INTO A DEVELOPMENT AGREEMENT WITH THE CITY, AND SUBJECT TO COMPLIANCE WITH THE RECOMMENDATIONS OF THE CITY PLANNER, CITY ENGINEER, AND CITY STAFF Page 146
